Does “on the highway” literally mean on...the highway? Like maybe it’s okay to not have a muffler on surface roads or like for a farm vehicle?

“On the highway” is typically how laws mean “public roads”.

My interpretation is that there's plenty of mods that are "for off road use only". EG: the 7.3 has an EBPV (exhaust back pressure valve) which chokes the exhaust to speed up engine warm up but even when open restricts exhaust flow and leaks oil. Deleting it with a delete kit is "for off road use only". Which I guess is how they're allowed to sell it without DOT SAE stamps. Same goes for off-road lights. Mean while we have states that have the strictest emissions control and some states without inspections at all... *Cough* Florida

Most of the stuff on my Mini is only for "off highway use in California". Guess I'm never relocating to Cali.

That’s great if you’re the guy with duct tape and a coat hangar. Less good if you have to share the road with him.

I put an air intake heater delete plug on the 250 and it was labeled as not available in California. No where in Cali would it ever meet the requirements for the AIH to even activate let alone it have environmental impact from being deleted.
